The laws that now apply to AI-generated people
This is general information, not legal advice. An operator running AI personas across countries should have a lawyer check the setup.
- No real people without consent. The US TAKE IT DOWN Act, signed on May 19, 2025, criminalises publishing intimate images of real people without consent, including AI-generated "digital forgeries", and requires platforms to remove reported images within 48 hours, according to the Congressional Research Service.
- Label AI content and AI chat in the EU. Article 50 of the EU AI Act, applying from 2 August 2026, covers both deepfake content and AI systems that talk to people, as the European Commission explains.
- Disclose bots that sell in California. California's bot disclosure law bars using a bot that misleads people about being a bot to encourage a purchase.
- Nobody who looks underage. Every platform bans it, and so does the law. There are no exceptions for AI.
Should an agency add AI OnlyFans models?
- Yes, if you already know how to drive traffic and run an inbox, and you are willing to run the accounts on a platform that allows them, with clear disclosure.
- No, if the plan is to pass an AI persona off as a real person on OnlyFans. It breaks the platform's rules and puts every account at risk.
